Acceptance Of Terms.

These Terms of Service ("Terms", "Agreement") constitute a legally binding agreement between you ("user", "you", "your") and WhichRanks Inc., a Delaware corporation ("WhichRanks", "we", "us", "our"), with its principal place of business at 234 Atlantic Avenue, Brooklyn, NY 11201, United States.

By accessing, browsing, or otherwise using WhichRanks.com (the "Site"), our newsletter, or any related services we provide (collectively, the "Service"), you agree to be bound by these Terms in their entirety. If you do not agree with any part of these Terms, you must not access or use the Service.

Acceptance Methods

You accept these Terms by: (1) visiting our Site, (2) subscribing to our newsletter, (3) submitting any form on the Site, or (4) otherwise using any feature of the Service. Continued use after we update these Terms constitutes acceptance of the updated version.

Description Of Service.

WhichRanks is a publishing and information service that provides independent brand and product comparisons, reviews, rankings, and buying guides across multiple categories. Our Service includes — but is not limited to — the following:

Service Availability

We aim to provide the Service on a 24/7 basis, but we do not guarantee uninterrupted availability. The Service may be temporarily unavailable due to maintenance, upgrades, technical failures, or other reasons. We are not liable for any losses caused by such interruptions, and we reserve the right to modify, suspend, or discontinue any feature of the Service at any time without notice.

No Professional Advice

The information on WhichRanks is provided for general informational and educational purposes only. It is not professional advice — whether legal, financial, medical, technical, or otherwise. While we make every reasonable effort to ensure accuracy through our methodology, you should not rely solely on our content when making purchasing or business decisions. Always conduct your own due diligence and consult appropriate professionals for advice specific to your circumstances.

Section Three

Eligibility & Account Use.

You must be at least 16 years of age to use the Service, submit any form, or subscribe to our newsletter. If you are under 16, you may not use the Service in any capacity. For more on our policies regarding minors, see Section 11 of our Privacy Policy.

Account-Free Service

Most of WhichRanks is available without creating an account. Browsing categories, reading reviews and comparisons, and using all of our editorial content does not require registration. Where account-like features exist (e.g., newsletter subscriptions, comment systems, saved comparisons in future product offerings), the following rules apply:

  • Accurate information. You must provide accurate, current, and complete information when subscribing or submitting forms.
  • Account security. If we offer account features in the future, you are responsible for safeguarding your credentials and notifying us immediately of any unauthorized use.
  • One identity per user. You may not create multiple subscriptions or submissions impersonating different people. You may not use false information.
  • No automated registration. Forms must be filled out by a human. Automated tools, scripts, and bots are prohibited from submitting forms (see Section 05).

Commercial Use Restrictions

The Service is intended for personal, non-commercial use by consumers and business buyers making purchasing decisions. Commercial use of our content — including republishing, syndication, training AI models, or systematic data extraction — requires our prior written permission. See Section 04 for full details on intellectual property rights and permitted uses.

Section Four

Intellectual Property Rights.

All content on WhichRanks — including text, graphics, photographs, illustrations, logos, layout, design, software, audio, video, and the selection and arrangement thereof — is owned by WhichRanks Inc. or its licensors and is protected by copyright, trademark, and other intellectual property laws of the United States and other jurisdictions.

What You Can Do

  • Read and browse all content on the Site for personal, non-commercial use.
  • Share links to specific pages — comparison pages, reviews, guides — via social media, email, or other channels.
  • Quote short excerpts (under 100 words) with proper attribution and a link back to the original page, for purposes consistent with fair use doctrine.
  • Print individual pages for personal reference (e.g., taking notes while shopping).
  • Embed our share buttons when provided.

What You Cannot Do

  • Republish or reproduce substantial portions of our content (more than a short excerpt) without our prior written permission.
  • Train AI models or machine learning systems on our content. This explicitly includes — but is not limited to — using our content as training data for large language models, image generation models, or any other AI/ML system.
  • Scrape, crawl, or systematically extract data from the Site using automated tools (bots, scrapers, crawlers) except for legitimate search engine indexing.
  • Frame or mirror our content on another site or service.
  • Remove or alter any copyright, trademark, or attribution notices from our content.
  • Use our trademarks, logos, or brand assets without our prior written permission, including the WhichRanks name, "Which Ranks" wordmark, gold-and-ink color scheme, or related brand identifiers.

Brand Trademarks & Logos

Names, logos, and trademarks of third-party brands appearing on WhichRanks — including in our comparisons, reviews, and category pages — are the property of their respective owners. Their inclusion on our Site does not imply any endorsement of WhichRanks by those brands, or any affiliation between WhichRanks and those brands except where explicitly disclosed.

DMCA Notice

WhichRanks complies with the Digital Millennium Copyright Act (DMCA). If you believe content on our Site infringes your copyright, please submit a DMCA notice to dmca@whichranks.com including: (1) identification of the copyrighted work; (2) identification of the allegedly infringing material; (3) your contact information; (4) a statement of good-faith belief; (5) a statement of accuracy under penalty of perjury; (6) your physical or electronic signature.

Section Five

Prohibited Conduct.

When using WhichRanks, you agree not to engage in any of the following activities. Violation of this section may result in immediate termination of your access (see Section 12) and may also result in legal action.

Technical Prohibitions

  • No scraping or unauthorized data extraction. Do not use bots, crawlers, scrapers, or other automated tools to extract content beyond what legitimate search engine indexing requires.
  • No reverse engineering. Do not decompile, disassemble, or reverse-engineer any portion of the Service or its underlying technology.
  • No security circumvention. Do not attempt to bypass authentication, rate limits, access controls, or other security features.
  • No denial-of-service attacks. Do not engage in activities that overload, disrupt, or impair the Service.
  • No malware distribution. Do not upload, transmit, or distribute viruses, malware, ransomware, or other malicious code.
  • No unauthorized access. Do not access any non-public area of the Service, including internal databases, admin panels, or staff accounts.

Content & Conduct Prohibitions

  • No impersonation. Do not impersonate any person or entity, including WhichRanks staff, brands we cover, or other users.
  • No false information. Do not submit false, misleading, or fraudulent information through any form, review, or feedback channel.
  • No defamatory content. Do not submit content that is libelous, defamatory, harassing, hateful, or threatening.
  • No illegal content. Do not submit or transmit content that violates any applicable law, regulation, or third-party right.
  • No spam. Do not use our contact forms, review systems, or other channels for unsolicited marketing, promotional content, or bulk messaging.
  • No vendor manipulation. Brands, their employees, agencies, or paid review services are prohibited from submitting fake reviews, fake ratings, or otherwise manipulating user-generated content. See our editorial policy Section 08.

Commercial Prohibitions

  • No competing republication. Do not copy our rankings, reviews, or comparisons to create a competing comparison site or service.
  • No AI training. Do not use our content to train AI models, machine learning systems, or any other automated content-generation system without our prior written consent (see Section 04).
  • No commercial scraping. Do not extract pricing data, brand rankings, or other structured information for commercial purposes.
  • No fraudulent affiliate activity. Do not engage in click fraud, cookie stuffing, or other manipulation of our affiliate tracking systems.

Section Six

User-Generated Content.

You may submit content to WhichRanks through various channels — including reader ratings, reader reviews, comments, contact form messages, brand suggestions, and editorial tips. These submissions are collectively referred to as "User Content." This section describes your rights and obligations regarding User Content.

Your Rights In User Content

You retain all ownership rights in your User Content. WhichRanks does not claim ownership of any User Content you submit. However, by submitting User Content, you grant us a license to use it as described below.

License To WhichRanks

By submitting User Content, you grant WhichRanks a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to:

  • Use, copy, reproduce, distribute, display, and publish your User Content in connection with the Service.
  • Modify and adapt your User Content for formatting, length, clarity, or moderation purposes (without changing its substantive meaning).
  • Aggregate your User Content with other users' submissions to produce reader-rating averages, sentiment summaries, and similar derivative analysis.
  • Display attribution as you've authorized (display name, anonymous, etc.).

This license continues for as long as your User Content remains on the Service. You can withdraw consent and request removal of your User Content at any time (see Section 07 of our Privacy Policy for the deletion process).

Your Warranties

By submitting User Content, you warrant that:

  • You own all rights in the content, or you have obtained all necessary permissions to grant us the license described above.
  • Your content does not violate any third party's intellectual property, privacy, publicity, or other rights.
  • Your content does not contain any defamatory, illegal, hateful, harassing, or other prohibited material (as defined in Section 05).
  • Your content is not part of an organized campaign by a brand, agency, or paid review service to manipulate our reader-rating systems.

Moderation & Removal

We reserve the right (but not the obligation) to moderate, edit, or remove User Content for any reason — including violation of these Terms, violation of our editorial policy, or at the discretion of our editorial team. We do not pre-screen all User Content, and we are not responsible for User Content submitted by others.

No Confidentiality

Do not submit confidential, proprietary, or sensitive personal information through our forms or review systems. Any content submitted is treated as non-confidential and may be displayed publicly (with appropriate attribution as you've authorized).

Section Seven

Affiliate Links & Commerce.

WhichRanks participates in affiliate marketing programs and may earn commissions when you click on certain links and make qualifying purchases from third-party brands. This section describes how affiliate links work, what we do (and don't do) with them, and what your responsibilities are when purchasing through them.

How Affiliate Links Work

  • Certain links on our Site — labeled with "Ad" or marked with rel="sponsored" — are affiliate links that direct you to third-party brand websites.
  • When you click an affiliate link, the brand's affiliate network may set tracking cookies on your device. If you make a qualifying purchase within their tracking window (typically 24 hours to 90 days), we earn a small commission.
  • The commission comes from the brand's marketing budget — not from any added cost to you. You pay the same price whether you click through us or visit the brand directly.

Editorial Independence

The fact that we earn affiliate commissions does not influence our editorial rankings or recommendations. Our scoring is finalized before any commercial conversation with brands, and the editorial team operates under strict independence safeguards described in our editorial policy. If a lower-paying brand is the better pick for your use case, we recommend the lower-paying brand.

Your Purchase Is With The Brand

  • We are not the seller. When you purchase a product or service through an affiliate link, your purchase agreement is between you and the third-party brand — not with WhichRanks.
  • We do not handle payments. Payment is processed by the brand's payment systems; we do not see or store your payment information.
  • We do not fulfill orders. Product delivery, service activation, customer support, returns, refunds, and warranties are all the responsibility of the third-party brand.
  • Brand terms apply. Your purchase is governed by the third-party brand's terms of service, privacy policy, and applicable consumer protection laws — not by WhichRanks's Terms.
Important: Verify Pricing & Terms

While we update prices regularly (see our methodology), pricing on third-party brand websites can change at any time. Always verify the current price, terms, and features directly with the brand before completing your purchase. WhichRanks is not responsible for pricing discrepancies between our Site and the brand's checkout page.

Sponsored Content

Some content on the Site is sponsored — meaning a brand has paid for placement of specific content. Sponsored content is always clearly labeled and looks visibly different from our editorial content. Our editorial policy Section 03 describes the full disclosure framework. Sponsored content is also subject to these Terms.

Section Eight

Third-Party Content & Links.

The Service contains links to third-party websites, services, brands, and content that are not owned or controlled by WhichRanks. These third parties have their own terms of service, privacy policies, and content standards.

No Endorsement Or Control

  • We do not control third-party sites. WhichRanks has no control over the content, accuracy, privacy practices, or operational policies of any third-party site or service linked from our Site.
  • We do not endorse third parties. Links to third-party sites do not constitute endorsement, sponsorship, or recommendation of those sites or their operators (except where explicitly stated in our editorial rankings).
  • You access at your own risk. Your use of any third-party site, service, or product is at your own risk and subject to the third party's own terms.
  • We are not liable for third-party issues. WhichRanks is not responsible for any losses, damages, or issues you may experience as a result of using or relying on third-party content or services.

Brand Information Accuracy

While we make every reasonable effort through our methodology to ensure that brand information on our Site is accurate and current, we cannot guarantee that all information about every brand is up-to-date at all times. Brand features, pricing, terms, and availability can change rapidly. You should always verify critical information directly with the brand before relying on it for purchasing decisions.

Stock Imagery & Brand Logos

Images on the Site may include licensed stock photography (e.g., from Unsplash and similar providers), brand logos retrieved via third-party logo APIs (e.g., Clearbit), and original photography produced by our editorial team. Use of brand logos is for editorial, comparative, and informational purposes only; all brand logos and trademarks remain the property of their respective owners.

Disclaimers & "As-Is" Service.

The following section contains important legal disclaimers. While we work hard to provide accurate, current, and useful content through our testing methodology, we cannot guarantee every aspect of the Service, and you accept certain risks by using it.

"As-Is" And "As-Available"

THE SERVICE AND ALL CONTENT ARE PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WHICHRANKS DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • Implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • Warranties regarding accuracy, reliability, completeness, or timeliness of content.
  • Warranties of uninterrupted access or error-free operation.
  • Warranties regarding third-party content, products, or services.

Content Disclaimers

  • Rankings are opinions. Our reviews, comparisons, and rankings reflect our editorial team's opinions based on our methodology. Reasonable people may disagree with our verdicts.
  • Pricing accuracy. While we verify pricing every 30 days, prices can change at any time. Always confirm current pricing directly with the brand.
  • No financial or legal advice. Content on WhichRanks is not financial, legal, medical, or other professional advice. Consult appropriate professionals for advice on your specific situation.
  • Forward-looking statements. Predictions, projections, or forward-looking statements may not prove accurate. Past performance does not guarantee future results.
Your Risk, Your Decision

You acknowledge that your use of the Service and any reliance on our content is at your sole risk. WhichRanks is not liable for purchasing decisions made based on our rankings, and we strongly encourage you to conduct your own due diligence before making any significant purchase.

Section Ten

Limitation Of Liability.

This section limits WhichRanks's legal liability to you. Please read it carefully — it affects your legal rights.

Cap On Damages

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WHICHRANKS, ITS DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY:

  • Indirect, incidental, special, consequential, or punitive damages — including lost profits, lost revenue, loss of business opportunity, loss of goodwill, or loss of data — even if WhichRanks has been advised of the possibility of such damages.
  • Damages arising from third parties — including loss caused by third-party brand actions, products, services, or content accessed through the Service.
  • Damages from Service interruptions, security incidents, or temporary unavailability.
  • Damages from inaccurate, incomplete, or outdated content, even content we have made reasonable efforts to keep current.

Maximum Liability

In all events, WhichRanks's total cumulative liability to you for any and all claims arising from or related to the Service shall not exceed the greater of:

  • $100 USD, or
  • The total amount you have paid to WhichRanks in the twelve (12) months preceding the claim (which for free users is $0).
Jurisdictional Exceptions

Some jurisdictions do not allow the exclusion or limitation of certain damages (e.g., for gross negligence, willful misconduct, or personal injury caused by negligence). To the extent such limitations are unenforceable in your jurisdiction, WhichRanks's liability is limited to the minimum allowed by applicable law.

Essential Bargain

You acknowledge that the limitations of liability described in this section reflect a reasonable allocation of risk between you and WhichRanks, and that without these limitations, WhichRanks would not be able to provide the Service to you free of charge. The limitations in this section apply even if the remedies provided under these Terms would otherwise fail of their essential purpose.

Section Eleven

Indemnification.

To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless WhichRanks, its officers, directors, employees, agents, partners, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses — including reasonable attorneys' fees — arising out of or related to:

  • Your use of the Service in violation of these Terms.
  • Your violation of any law, regulation, or third-party right (including intellectual property, privacy, or publicity rights).
  • Your User Content, including any claim that your User Content infringes third-party rights or violates applicable law.
  • Your purchasing decisions made in reliance on our content — to the extent you bring or threaten to bring any claim against WhichRanks related to such purchases.
  • Your interactions with third-party brands linked from the Service, including purchases, disputes, returns, or warranty claims.
  • Your gross negligence or willful misconduct in connection with the Service.

Defense Of Claims

WhichRanks reserves the right (at our own expense) to assume the exclusive defense and control of any matter for which you are required to indemnify us, in which case you agree to cooperate with our defense of such claim. You agree not to settle any matter without our prior written consent. We will use reasonable efforts to notify you of any such claim upon becoming aware of it.

Section Twelve

Termination & Suspension.

These Terms remain in effect for as long as you use the Service. Either you or WhichRanks may terminate this agreement under the conditions described below.

Termination By You

You may stop using the Service at any time. If you've subscribed to our newsletter, you can unsubscribe through the one-click unsubscribe link in any email or by using our contact page. If you've created any account-like features (in future product offerings), you can request account deletion through the same channels.

Termination By WhichRanks

We may suspend or terminate your access to the Service — in whole or in part, with or without notice — for any of the following reasons:

  • Violation of these Terms, our editorial policy, or any other applicable WhichRanks policy.
  • Engagement in prohibited conduct as described in Section 05.
  • Activity that exposes WhichRanks to legal liability or undermines the integrity of the Service.
  • Fraudulent, deceptive, or abusive behavior — including click fraud on affiliate links, fake reviews, or impersonation.
  • At our discretion, if we believe in good faith that termination is necessary to protect WhichRanks, other users, or the public.

Effect Of Termination

  • Your right to access the Service ceases immediately upon termination.
  • Any User Content you've submitted remains subject to the license granted in Section 06 (though you can request deletion per our Privacy Policy).
  • Sections that by their nature should survive termination — including Sections 04 (IP), 09 (Disclaimers), 10 (Liability), 11 (Indemnification), 13 (Disputes), and any accrued obligations — survive termination.
  • WhichRanks is not liable to you for any termination of your access to the Service.

Section Thirteen

Governing Law & Disputes.

This section describes which laws govern these Terms and how disputes are resolved if they arise.

Governing Law

These Terms and any dispute arising out of or related to them or the Service are governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.

Informal Resolution First

Before bringing any formal legal claim, you agree to first contact WhichRanks at legal@whichranks.com or through our contact page with subject "Legal/dispute" to attempt to resolve the matter informally. We will respond within 30 days, and most disputes can be resolved without formal proceedings. If we cannot resolve a dispute within 60 days of your informal notice, either party may proceed with formal dispute resolution.

Mandatory Arbitration (US Users)

For users in the United States, any dispute arising out of or related to these Terms or the Service — except as described in the exceptions below — will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will be conducted in New York, NY, or remotely at the arbitrator's discretion. Judgment on the arbitrator's award may be entered in any court of competent jurisdiction.

Class Action Waiver

YOU AND WHICHRANKS AGREE THAT ANY DISPUTE WILL BE BROUGHT IN AN INDIVIDUAL CAPACITY AND NOT AS PART OF A CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate claims of multiple users and may not preside over any form of representative proceeding.

Exceptions To Arbitration

The following types of disputes are not subject to mandatory arbitration and may be brought in court: (1) small claims court actions; (2) injunctive or equitable relief to enforce intellectual property rights; (3) actions to address violations of Sections 04 (IP) or 05 (Prohibited Conduct); (4) any dispute where arbitration is prohibited by applicable consumer protection law.

Jurisdiction For Non-Arbitrated Disputes

For any dispute not subject to arbitration, the parties consent to the exclusive jurisdiction of the state and federal courts located in New York County, State of New York, United States, and waive any objection to venue in those courts.

EU/UK Users

If you are a consumer residing in the European Union or United Kingdom, mandatory consumer protection laws of your country of residence apply notwithstanding the choice of New York law. You may also have the right to bring proceedings in the courts of your country of residence. EU residents may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

Section Fourteen

Changes & Contact Information.

We may update these Terms from time to time — to reflect changes in our practices, legal requirements, or to improve clarity. Material changes will be communicated through the following channels:

  • Last Updated date. The date at the top of this page always reflects the most recent revision.
  • Version number. Each material change increments the version number (currently v3.2).
  • Email notification. For material changes, we'll email newsletter subscribers at least 30 days before changes take effect.
  • Site banner. A prominent banner will appear on the Site for at least 14 days following a material change.
  • Historical versions. Previous versions of these Terms are available on request at legal@whichranks.com.

Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms. If you do not agree with material changes, you should stop using the Service before the changes become effective.

Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

Entire Agreement

These Terms — together with our Privacy Policy, Editorial Policy, and any other policies referenced herein — constitute the entire agreement between you and WhichRanks regarding your use of the Service, and supersede all prior agreements, communications, and proposals on the subject.

No Waiver

The failure of WhichRanks to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of WhichRanks.

Assignment

You may not assign or transfer these Terms or any rights under them without our prior written consent. WhichRanks may freely assign these Terms in connection with a merger, acquisition, or sale of assets — your continued use of the Service after such assignment constitutes your acceptance of the new entity as a party to these Terms.

"Terms are the framework. Trust is the actual product. We try to keep both honest, plain-spoken, and updated when they need to be."
